On August 10th, 2006, Daniel Cicciaro Jr, 17, a recent graduate of Newfield High School in Selden, went to a birthday party in Sound Beach, Long Island, with several of his friends – the night ended with a fatality – we hope you enjoy this episode.

  • Enjoyed the podcast; but a few major issues. The bat in question never left the car. That wasn’t just the testimony of Cicciaro’s friends at the scene, but also the White’s themselves, they were never threatened with the bat. I am not sure where you got the idea that the shotgun was discharged, because that also never occurred. Saying Race had nothing to do with this case ignores White’s entire defense, White talked extensively about his fear of the Klan and stories from his family about lynchings, etc., when he testified. White’s lawyer, Fred Brewington, talked about race in his closing argument as well, using the “Fear of the Klan” defense, essentially. And lastly, John White only served 5 months of his sentence, not 2 years, before his sentence was commuted by Governor Patterson. Full disclosure, I am a former ADA from Suffolk (Although I left long before this case) and am now a criminal defense attorney, so I am prone to maybe overreacting a bit if people get the facts wrong on a trial -because the press has done it to me- I realize it’s a Podcast and not Newsday, but you may want to dig a little deeper next time.
